These Conditions apply to every quotation, order and supply of goods (and, where your order includes them, installation services) by World of Tiles (“we”, “us”) to you. By placing an order, paying a deposit, or signing or accepting a quotation that refers to these Conditions, you agree to them. Nothing in these Conditions excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded; everything else applies to the extent permitted by law.

1. About our products. Tiles are fired clay products: shade, tone and size variation between batches, and minor variation from showroom samples, are natural characteristics of the product, not faults. Where stock allows we will supply from a single batch.

2. Quotations and price. Quotations are valid for [30] days unless stated otherwise. Prices are in Australian dollars and include GST. We may pass on supplier price increases that occur between quotation and delivery if we tell you in writing first.

3. Deposit and payment. A deposit of 20% of the quoted price is payable on acceptance and the balance is payable on or before delivery. We accept [EFT and card] with no surcharge. Overdue amounts attract interest at 10% per annum (calculated daily) and you agree to pay our reasonable costs of recovering any debt.

4. Plan estimation and quantity advice. We may help estimate the quantity of tiles you need — from your plans, your measurements, or discussion in store, by phone or email. Any estimate we give is a good-faith indication only and is not a guarantee or warranty. Actual quantities depend on cuts, wastage, layout and other site factors we cannot fully verify, so we strongly advise you or your installer to confirm the quantity required independently before ordering and again before delivery. To the extent permitted by law, we are not responsible for any shortfall or surplus arising from a quantity we have estimated; any surplus is subject to the change-of-mind return rules in clause 9. Advice from your installer or any other third party is not advice by us. Any additional tiles you order after your initial delivery that are in our current stock are subject to clause 9; however, where we have to source matching-batch material specifically for your job, those tiles are sold on a final-sale basis (non-returnable) and any direct procurement costs (such as urgent freight) will be added to the price. We will tell you which of these applies at the time you place the order.

5. Suitability. It is your responsibility to confirm that the tiles you select are suitable for the intended application (wet area, floor, external use, etc.). If you tell us the purpose at the time of order we will advise you to the best of our ability; to the extent permitted by law, we are not responsible for tiles selected for an application we were not asked about.

6. Delivery and risk. If we arrange delivery, risk in the goods passes to you on delivery to the address you nominate. If you arrange your own carrier, risk passes when the goods are loaded for collection. Please inspect the goods on receipt and tell us in writing within 7 days of any damage or shortage so we can investigate while evidence is fresh. This time limit does not affect any rights you have under the ACL for faulty goods that emerge later.

7. Uncollected goods. Once we notify you that your order is ready for collection, please collect it within 14 days. If goods remain uncollected after 21 days from our notice, we may charge a reasonable weekly storage fee. We may dispose of goods left uncollected for more than 60 days from our notice, in accordance with the Uncollected Goods Act 1995 (NSW); any further notice required by that Act will be given. Sale proceeds will first be applied to amounts you owe us (including outstanding balance, storage and recovery costs), with any surplus refunded to you.

8. Faulty goods and your consumer rights. Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. For a failure that is not major, you are entitled to have the goods repaired or replaced. To make a claim, contact us in writing with your invoice number, photographs and a brief description and we will respond promptly.

9. Change-of-mind returns. We may accept returns of at least 2 unopened boxes within 1 month of delivery, provided we still hold the same batch in current stock. A 20% restocking fee applies; please quote your invoice number. Borders, features, stone, mosaics, and goods made or cut to order are not returnable.

10. Title and PPSA. Title to the goods passes only when we receive cleared payment of all amounts owing; until then the goods are at your risk but remain our property. These Conditions create a security interest in our favour under the Personal Property Securities Act 2009 (Cth) over the goods and their proceeds. You consent to us registering that interest on the Personal Property Securities Register, agree to do whatever is reasonably necessary to enable us to do so, and waive your right to receive notices under sections 95, 118, 121(4), 130, 132(3)(d), 132(4) and 135 of that Act. If you do not pay on time, we may, on reasonable notice and at reasonable hours, enter the premises where the unpaid goods are kept to recover them, taking reasonable care to avoid damage.

11. Standards and workmanship. Tiles supplied by us comply with the applicable Australian Standards for ceramic tiles. Where we install, installation will be performed with due care and skill by qualified installers in accordance with AS 3958 (Installation of Ceramic and Stone Tiles) and the National Construction Code as applicable.

Installation services — clauses 12–14 apply only where your order includes installation by us.

12. Underground services. You must tell us, before installation, about any underground services or obstructions on site (cables, water, gas, drainage, concrete, rock). We will take reasonable care; to the extent permitted by law, we are not responsible for damage to undisclosed services, and any additional cost we reasonably incur because of them is payable in addition to the quoted price.

13. Progress and completion. For larger jobs, progress payments may be invoiced as work proceeds (each at least 10% of the contract price and not exceeding 90% of the value of work and materials supplied to date), payable within 7 days. Completion dates shown on the quotation are estimates given in good faith; we will tell you promptly if a delay is likely.

14. Installation warranty. In addition to your rights under the ACL, we warrant our installation workmanship against defects for 24 months from the date of completion. We will, at our option, repair or replace defective workmanship at no charge during that period. The warranty does not cover damage caused by fire, tempest or other event beyond our reasonable control, or by the deliberate, reckless or negligent acts of any person other than us or our personnel.

General
15. Force majeure. We are not liable for delay or failure to supply caused by events beyond our reasonable control (including natural events, supplier failure, transport disruption, industrial action and government action), provided we notify you as soon as practicable and use reasonable efforts to mitigate.

16. Privacy. We handle personal information in accordance with our Privacy Policy (available on request) and the Privacy Act 1988 (Cth).

17. Governing law and general. These Conditions are governed by the law of New South Wales and the parties submit to the non-exclusive jurisdiction of its courts. If any provision is found to be void or unenforceable, the remainder continues in effect. The version of these Conditions that applies to your order is the version in force on the date you accept the quotation.
